AB 1075 would require that a State of Emergency automatically terminate 60 days after the Governor’s proclamation unless the Legislature chooses to extend it. Under current law, the Governor is given the power to proclaim termination of a State of Emergency at the earliest possible date that conditions warrant. Recent COVID “emergency declarations” were in place for 3 years without any requirement for the legislature to oversee the governor’s overly broad powers.
