OPPOSE
AB 1090 would authorize the county board of supervisors to remove a sheriff from office for cause by a supermajority vote. Existing law already provides for the removal of public officers for willful or corrupt misconduct in office based on a conviction by the court. Nearly every act under the bill’s definition of “for cause” would already be a violation of existing criminal law. AB 1090 would allow the board of supervisors to subvert th ewill of voters, introduces political considerations into the performance of a Sheriff’s job, and raises a separation of powers question as the county’s legislative branch would hold this authority over the executive branch.
