AB 1314 would provide that a parent or guardian has the right to be notified in writing within 3 days from the date any teacher, counselor, or employee of the school becomes aware that a pupil is identifying at school or school-related activities as a gender that does not align with the child’s sex on their birth certificate or sex assigned at birth, or at school-related activities. 

The bill intends to bring parents and guardians into the decision-making process for mental health and social-emotional issues of their children at the earliest possible time in order to prevent or reduce potential instances of self-harm. Public schools are meant to support parents in their efforts to educate their children, not to subvert it. Parents are ultimately responsible for their children and should be aware of all information associated with their public education process. 

On February 16, 2023, Assemblyman Bill Essayli (R-Riverside) introduced Assembly Bill 1314. However, the chair of the Assembly Education Committee refused to hear the bill this year. The bill is eligible to be heard at a future date.
